The Firm successfully prosecuted wrongful death and survival claims on behalf of an individual involved in a fatal, head-on collision with a truck driver operating an 18-wheeler on behalf of one of the largest trucking companies in the country. Depositions were taken in Texas, Minnesota and Nebraska, and the case, after years of hotly contested litigation involving extensive fact and expert discovery and motion practice, settled favorably for a confidential amount shortly before trial. The litigation was marked early on by the trucking company’s alteration of key physical evidence in this case, namely the repairing of the tractor-trailer units prior to Plaintiffs’ accident reconstructionist having had an opportunity to inspect the units. The spoliation of evidence was the subject of an extensive evidentiary hearing and a significant sanctions award.
